All foreign workers must obtain permission to legally work in the United States. It is very important that you follow the instructions of the U. S. Citizenship and Immigration Services, (USCIS) when applying for an H1B visa and upon receiving a visa. Any violations can result in denial of your application or removal from the United States.
Hiring Unit Managers are responsible for assisting non-immigrant candidates who have been selected to fill vacant positions with determining their need of possessing an H1B visa. Once it is determined that the selected candidate needs an H1B visa, the hiring unit will submit to the Office of Human Resources, a letter of request to hire the selected candidate (approved by the Provost for academic positions or area Vice President, Chief of Staff, or Director of Intercollegiate Athletics for non-academic positions), giving specific details of the intended hiring arrangements, to include the start date of employment and ending date of employment to cover a 3 year period of time; specific job title; salary and benefits that the selected candidate will receive in exchange for his or her services, along with a brief statement of support indicating why the candidate was selected. The hiring unit is responsible for all fees associated with the petitioning for the H1B visa on the behalf of the selected candidate.
*H1B requests for faculty must be submitted to the Office of Human Resources 60 days (45 days for premium processing) prior to the beginning of the semester in which he/she will start work.
*H1B requests for non faculty must be submitted to the Office of Human Resources 60 days (45 days for premium processing) prior to the anticipated start date of employment.
The Office of Human Resources will complete the application to petition for the H1B visa and submit it along with all supporting documents that are provided by the selected candidate and hiring unit. The Office of Human Resources will communicate what information it receives with the hiring unit as it becomes available. The Office of Human Resources does not make any decisions regarding approvals or denials of requests for visas. Once the Office of Human Resources receives a “Receipt #” for the application submitted, it will be shared with the hiring unit to access the USCIS online website http://www.uscis.gov/ . The “Receipt #“ will allow the hiring unit and selected candidate to access online status reports of the application.
